These Community License Terms of Use (the "Community Terms") govern your download and use of the free Octeth Community build (the "Community Build") provided by 50SAAS LLC (d/b/a Octeth), a Wyoming limited liability company ("Octeth," "we," "us," or "our"). They take effect on September 1, 2026. Please read them before downloading, installing, or using the Community Build.
About These Terms
The Community Build is a separate, free Octeth build for one business sending its own email. Your use of it is governed by these Community Terms and by the End-User License Agreement (the "EULA"). Where these Community Terms conflict with the EULA, these Community Terms control for the Community Build.
By downloading, installing, or using the Community Build, you agree to these Community Terms and the EULA. If you do not agree, do not download, install, or use the Community Build.
Getting the Community Build
The Community Build is available only from the Octeth client area at my.octeth.com, after you register an account. You agree to give accurate registration information. The Community License is free and requires no credit card.
What You May Do
Subject to these Community Terms, Octeth grants you a free, non-exclusive, non-transferable license to:
- Install the Community Build on servers you control.
- Use it to send your own business's email, including marketing and transactional email.
- Use the Octeth documentation to install and operate it.
Limits
The Community License has the following limits:
- One user account. You may use one (1) user account.
- 10,000 subscribers. You may store and send to up to 10,000 subscribers in total across your installation.
- Octeth branding stays on. The Community Build does not include white-label. Octeth branding must remain in place.
What You May Not Do
You may not, and may not permit any third party to:
- Use the Community Build to send email for clients or any other third party.
- Resell, sublicense, rent, or lease the Community Build, or offer it or its functionality as a service to third parties.
- Remove, hide, or alter the Octeth branding.
- Exceed the limits above, or bypass, disable, or tamper with any mechanism that enforces them.
- Redistribute the Community Build or make it available for download by others.
The restrictions in the "What You May Not Do" section of the EULA also apply.
Updates
The Community License includes no updates service, no upgrade assistance, and no entitlement to future versions. Octeth may publish new Community builds in the client area at its discretion. If it does, you may download them manually. Each Community build is governed by the Community Terms in effect when you download it.
Support
The Community License includes documentation only. It does not include technical support, training, installation or migration assistance, or service-level commitments.
Moving to a Paid License
If you need more than one user account, more than 10,000 subscribers, white-label, updates, support, or to send email for clients, you need a paid license. Paid licenses are governed by the EULA and the terms of your purchase. See paid licenses.
Earlier Downloads
Copies of the Community Build downloaded before September 1, 2026 remain under the terms in effect when they were downloaded. These Community Terms apply to copies downloaded on or after September 1, 2026.
Termination
Your Community License continues until terminated. Octeth may terminate it if you breach these Community Terms or the EULA and do not cure the breach within 30 days after we notify you in writing. You may terminate it at any time by ceasing all use of the Community Build and deleting all copies. On termination, you must stop using the Community Build and delete all copies in your possession or control.
Warranty & Liability
The Community Build is provided "AS IS" and "AS AVAILABLE," without warranty of any kind. The Disclaimer of Warranties, Limitation of Liability, Indemnification, Export & U.S. Compliance, and Governing Law sections of the EULA apply to the Community Build. The 30-day money-back guarantee does not apply, because there is no fee to refund.
Changes to These Terms
Octeth may change these Community Terms. Changes apply to Community builds downloaded after the change takes effect. They do not change the terms that apply to a copy you downloaded earlier.
